This website is operated by Audae Club. Throughout the site, the terms “we”, “us” and “our” refer to Audae Club. Audae Club offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing/renting something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
By renting or consigning a garment with Audae Club, you hereby acknowledge and agree to the following terms and conditions:

Rental and Delivery Timeframes:
You understand and accept the outlined order processing and shipping timelines provided by Audae Club, including the recommended rental duration to ensure prompt delivery and return of items and card vaulting, identity verification, authorization holds to ensure return of rental and full payment of fees. -
Refund and Cancellation Policy:
You agree to the refund and cancellation terms established by Audae Club, including applicable fees and store credit eligibility as specified in the policy. If you paid using Shop Pay Installments and you cancel or return an item (following return eligibility rules), you will only receive store credit, not a refund. Refunds are only granted in extreme, approved cases such as:-
- You received the wrong item.
- The item was severely damaged (beyond acceptable secondhand wear,) and Audae Club did not catch it before dispatch.

All other return reasons, including size, change of mind, or dislike, are only eligible for store credit minus shipping fees.
To be eligible for a refund or store credit, the item must be unworn and returned with the security ribbon and tags intact and untampered with. Store credit is valid for 24 months from the date of issue.

Condition of Rental Items:
You acknowledge that all rental items are inspected for quality before delivery and may exhibit minor signs of prior use, which you accept as part of the rental agreement. -
Consigning with Audae Club:
You agree to provide accurate details about your item, including brand, size, condition, receipts, and photos, through our submission form. Audae Club will review your submission to determine eligibility for our Consignment Program. If accepted, your item will be shipped to us for in-person inspection and, once approved, will enter a 90-day consignment period and be assigned a commission tier in accordance with our Consignment Policy. All items are subject to inspection upon receipt, and Audae Club may decline, downgrade, or return items that do not meet our standards; in such cases, return shipping will be at our expense. During the 90-day consignment period, you may request your item back at any time, subject to payment of return shipping costs. After 90 days, ownership of the item automatically transfers to Audae Club, and you will continue to earn commissions on qualifying rentals as outlined in our Consignment Policy and payout schedule.
Gift cards issued by Audae Club expire 2 years from the date of purchase. Expired gift cards are not eligible for reactivation, extension, or refund.
All items featured on Audae Club’s platform are pre-owned or consigned luxury items. The presence of designer branding on our site is for descriptive purposes only. Audae Club does not claim any association with or endorsement by the designers listed on our platform.
By confirming your rental or consignment with Audae Club, you affirm that you have read, understood, and agree to these terms and conditions in their entirety.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 - DISCLAIMER OF ASSOCIATION WITH DESIGNERS
Audae Club is an independent business entity and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with any designers whose items are featured on our platform. All designer names, logos, and trademarks displayed on our site are the property of their respective owners and are used solely to indicate the source of the second hand luxury items available for rent or purchase. These items have been lawfully acquired by Audae Club through consignment or purchase from third-party sellers. The use of any designer logos or names on our platform is strictly for informational purposes and does not imply any sponsorship, endorsement, or partnership with Audae Club.
SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 6 - PRODUCTS OR SERVICES (if applicable)
Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Rental, Return & Refund Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 7 - RENTAL RESERVATIONS
To reserve a rental, customers must place an order through our online platform. Audae Club secures chosen rental styles and dates only upon full payment of the rental fee. Rental periods are available for 4 days or 10 days. We encourage customers to plan ahead and reserve their rentals up to six months in advance for their special "a'day."
Rental durations include receiving the item on the first day of the rental period and returning it on the final day according to our Return & Refund Policy Rental, Return & Refund Policy. Orders are processed Monday through Friday from 9 AM to 5 PM EST. Orders placed on weekends will be processed on the next business day. Last Minute Orders (placed less than 3 days before the rental start date) are not eligible for a refund, even in the case of delayed delivery by UPS. Store credit may be issued in such cases, exclusive of postage costs.
SECTION 8 - EXTENDED RENTAL PERIODS
Extended rental periods are available upon request. To inquire, please email hello@audaeclub.com with "Extended Rental Period" in the subject line. Note that prices will be higher than the 4 & 10-day rentals.
SECTION 9 - CONDITION OF RENTAL ITEMS
Audae Club ensures all rental items meet the highest standards of quality. Here's how we maintain each rental piece:

Professional Cleaning: All rental items are professionally dry-cleaned by our trusted partner, EcoWise Cleaners LLC.

Detailed Restorations: Our skilled seamstresses inspect and repair items as needed to ensure excellent condition.

Premium Condition: While we aim to maintain items in "as new" or "near new" condition, minor visible repairs or imperfections may occur due to prior use.

Quality Guarantee: Each item is inspected before packing to ensure it meets our high standards.

Shopper Examination: Customers are encouraged to inspect garments before wearing them. Tags must remain intact; no refunds or credits will be issued once tags are removed.
SECTION 10 - RENTAL RETURNS, LATE RETURNS, UNWORN RETURNS, & PURCHASE RETURN
Please return items using the provided resealable post bag and return label. If a different shipping method is used, notify Audae Club at orders@audaeclub.com with tracking details. Customers are responsible for lost items without tracking. Late returns will incur fees, as specified below & in our Return & Refund Policy. A late fee of 20% of the rental fee will be charged for each day the rental item is returned late. These fees will be charged to the credit card on file. If items are not returned within 10 days after the return date, the customer will be charged 100% of the item's recommended retail value in addition to any rental fees. If the bill of additional charges is not paid within 7 days of issuance, or after three failed charge attempts, it will be escalated to a debt collector.
No refunds are issued for rental items returned unworn. If returned before the rental period ends, customers will receive store credit equal to the rental fee, only if you notify us immediately at orders@audaeclub.com to initiate store credit. Faulty items must be reported within 24 hours of receipt for exchange or refund. Every item undergoes a comprehensive inspection before packing to ensure its quality. While all rental dresses are professionally tailored and dry-cleaned prior to dispatch, minor repairs or permanent marks may be present due to the nature of rental garments. Audae Club is committed to upholding the highest standards for every style. For all details, rules, and exceptions, refer to the Return & Refund Policy. Purchased items can be returned for store credit or exchange within 30 days, excluding sale items marked as final sale. Returns must follow the Rental, Return & Refund Policy
Audae Club incurs shipping costs both to and from the customer, including the cost of providing a prepaid return label. These shipping expenses are non-refundable and will be deducted from eligible return refunds as follows to original payment method or store credit:
- Rentals under $100: $9 shipping deduction
- Rentals from $100 to $199: $15 shipping deduction
- Rentals of $200 and above: $25 shipping deduction

Should the charge be unsuccessful, the matter may be escalated to a third-party debt collection agency for further resolution.
SECTION 11 - CANCELLATION POLICY
Customers may cancel their rental order up to 7 days before the reservation start date for no charge. The order will be fully canceled and not charged.
If a cancellation is made within 7 days prior to the reservation start date, the customer will not be eligible for a refund. Instead, a store credit will be issued, minus a cancellation fee:

A $30 cancellation fee applies for dress rentals valued under $150.

A $60 cancellation fee applies for dress hire values of $150 or more.

The cancellation fee applies to all full-priced items within an order.
Once an item has been dispatched, it is no longer eligible for a refund. However, if approved by our team, a store credit may still be issued, minus any applicable shipping and cancellation fees.
Store Credit Issuance
Cancellations made within 7 days of the rental start date will receive a store credit for the full rental fee (excluding postage). Store credits are valid for 24 months from the date of issue.
Discounted Items: Please be aware that discounted items, that are less than the cancellation fee amount, are not eligible for a refund because their value is lower than the applicable cancellation fee.
Notification: Audae Club kindly requests that customers notify us of any cancellations as early as possible. Cancellations must be communicated before the item has been dispatched or collected. Once an item has left the store, only store credit will be issued.
Audae Club reserves the right to cancel an order with limited notice.
Potential reasons for cancellation include, but are not limited to, an item being unavailable due to a late return from a previous customer or damage to the item. While we make every effort to provide as much advance notice as possible, in the event of a cancellation by Audae Club, customers will be offered a full refund, store credit, or the opportunity to select an alternative item. SECTION 12 - POSTAGE
Audae Club ships all orders within the United States via UPS. Full details regarding available shipping methods, delivery timelines, and costs (including standard, expedited, and last-minute options) are outlined in our Shipping Policy.
Customers are responsible for reviewing the Shipping Policy before placing an order. By completing a rental or purchase, you acknowledge and agree to the shipping terms, including any applicable fees for expedited shipping and our policies regarding UPS delays, Route Package Protection, and delivery to remote areas.
Audae is not responsible for UPS delays, or for failures of shipping if customer doesn’t select Route protection.

SECTION 13 - DRY CLEANING
At Audae Club, we prioritize providing a seamless experience for every customer, including professional dry-cleaning services before and after the rental period, all covered in the rental cost. Our trusted partner, EcoWise Cleaners LLC, handles all cleaning, bringing years of expertise in maintaining the quality of each Audae Club style.
As part of the rental agreement, customers are asked not to attempt cleaning the dress themselves. If a customer attempts to clean the dress and causes permanent damage, they may be responsible for additional costs.
SECTION 14 - FIT GUARANTEE
To be eligible for the Fit Guarantee, items must have their tags intact upon return:
We will only issue store credit for fit issues, not refunds. Item must be unworn and have intact ribbon/tags.
Customers returning an item with the tags attached will receive store credit equivalent to the rental fee. Please note that postage fees are not included in the store credit, and will be deducted from your refund.
Contact Us Quickly: If the item does not fit, please contact us at orders@audaeclub.com as soon as possible. Our team will do our best to send a replacement style in time for your event. Additional postage fees may apply for sending an alternate item.
Sizing Assistance: Audae Club provides sizing information in standard US sizes, along with any relevant sizing notes in the product descriptions. If you’re unsure about which size to choose, feel free to contact us via email at hello@audaeclub.com.
SECTION 15 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

ID Verification Requirement
To help prevent fraud and ensure a secure rental experience, all customers are required to verify their identity upon checkout. After placing an order, customers will receive instructions to complete ID verification. If a customer fails to complete this verification or if Audae Club determines, at its sole discretion, that the information provided does not meet our trust and safety standards, the order will not be shipped. In such cases, the customer will not be charged for the rental.
Security Deposits
Audae Club reserves the right to require a refundable security deposit for certain rentals. By placing an order that includes a deposit, you authorize Audae Club to place a hold on your payment method for the specified deposit amount. This hold is not an immediate charge and will be released once the item is returned on time and in the condition it was sent.
You acknowledge and agree that Audae Club may retain all or a portion of the deposit in the event of damage, late return, or non-return of any rental item. The determination of applicable deductions will be at Audae Club’s sole discretion, in accordance with our Rental & Return Policy.
Failure to comply with return terms may also result in additional charges to the card on file. If the bill of additional charges is not paid within 7 days of issuance, or after three failed charge attempts, it will be escalated to a debt collector.
SECTION 16 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Certain content, products and Services available via our Service may include materials from third-parties.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

The use of any designer names, logos, or trademarks on Audae Club’s platform is solely to identify the products in our inventory. Audae Club makes no claims to ownership or association with these designers or their intellectual property.
SECTION 23 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Audae Club, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 24 - Damage, Loss, or Theft of Rented Items
Customers are responsible for ensuring the rented item(s) is/are handled with care and kept in good condition throughout the rental period. In the event of damage, loss, or theft of the item, the following terms apply:
Minor Damage Insurance: Audae Club provides complimentary insurance to cover minor damage or stains up to $30. This coverage includes repairs for damages or stains that can be fixed at a cost under $30. If the cost of repairs exceeds this amount, the customer will be responsible for paying the difference. For example, if a repair costs $75, the customer will be liable for the $45 excess. All charges for repairs or replacements will be applied to the customer's credit card on file, and the customer will be notified in advance of any additional charges. If the bill of additional charges is not paid within 7 days of issuance, or after three failed charge attempts, it will be escalated to a debt collector.
Loss, Theft, or Irreparable Damage: In cases of lost, stolen, or irreparably damaged items, the customer will be responsible for covering the full replacement cost. This is true regardless of the circumstances leading to the loss or damage. Audae Club will assess the replacement value based on factors such as the item's market demand, availability for purchase, condition, and the rental fee already paid. The replacement cost may be up to 100% of the item’s Secondhand Sales Price (SSP), in addition to the rental fees already paid.
The customer will be notified of any charges for replacement, and payment will be processed through the credit card provided during the rental.
Should the charge be unsuccessful, the matter may be escalated to a third-party debt collection agency for further resolution.
SECTION 25 - ROUTE PACKAGE PROTECTION TERMS
Route Package Protection is automatically added to all carts. You agree to adhere to the terms and conditions outlined by Route. Audae Club is not responsible for claims processed through Route but will assist you with the claim process if necessary.
SECTION 26 - CONSIGNING WITH AUDAE CLUB
By submitting a designer dress through our form, you affirm that you are the legal owner of the item and have the right to consign it to Audae Club. Items submitted must meet Audae Club’s quality, brand, authenticity, and style standards. The initial submission is completed through our online form, where you provide accurate details and photos of the dress. Audae Club reserves the right to decline items that do not meet our standards.
If your item passes the first evaluation, you will receive instructions for shipping it to Audae Club for final inspection. All shipping and returns for consigned items are handled in accordance with our Consignment Rules and Shipping Policy.
Audae Club currently operates exclusively under a consignment model. Items accepted into our program are governed by our Consignment Policy, including the 90-day consignment period, ownership transfer, and payout schedule. Payout to consignors will be on the 15th and 30th of every month. For more information review our Consignment Policy.
Note: While Audae Club previously offered one-time buyouts, this option is no longer available for new submissions. Any items Audae Club purchased outright before this policy change remain the property of Audae Club.
SECTION 27 - INDEMNIFICATION
